Statutory vs. Voluntary Lease Extensions
Option 1: Statutory Lease Extension Process
1. Checking Eligibility
You must have owned the property for at least 2 years.
The lease must be originally granted for more than 21 years.
2. Obtaining a Lease Valuation
A qualified surveyor will assess the premium payable to the freeholder.
3. Serving the Section 42 Notice
This legal notice formally requests a lease extension and starts the process.
The freeholder has 2 months to respond.
4. Freeholder’s Counter-Notice
The freeholder may accept, reject, or propose different terms.
If terms cannot be agreed, negotiations continue.
5. Tribunal (If Necessary)
If no agreement is reached within 6 months, the leaseholder can apply to the First-tier Tribunal to determine fair terms.
6. Completion & Registration
Once terms are agreed, the new lease is drafted, signed, and registered with HM Land Registry.

1. Negotiating with the Freeholder
Instead of serving a formal notice, you contact the freeholder directly to negotiate terms.
2. Valuation & Terms Agreement

4. Registration with HM Land Registry
